Kimo helps you access your employer’s workplace information and services. Your employer manages your account and employment arrangements. These terms govern use of Kimo; they do not change your employment contract or remove your statutory rights.
1. About these terms
Kimo is provided by Periwin Solutions Limited (“Periwin”, “we”, “us”), a UK company with its business contact address at 44a, Lowlands Road, Harrow, England, HA1 3AN, United Kingdom. You can contact us at info@periwin.com.
These terms apply to your use of the Kimo iOS and Android app and kimo.periwin.com. Please read them before using the service. If you cannot agree to them, contact your employer to discuss an alternative way of accessing necessary workplace information.
A separate agreement may govern the service we supply to your employer or another customer organisation. That agreement determines the organisation’s purchased services and commercial obligations. It does not make you personally responsible for your employer’s fees or commitments. These terms do not amend that agreement.
Kimo currently has no self-service subscription checkout or in-app purchases. Any charges for an organisation’s service are agreed with that organisation separately.
2. Accounts and authorised access
Your employer or account-providing organisation supplies your company site and account access, controls your permissions and decides which features and records are available. Kimo does not currently offer public self-service account registration.
Use only an account you are authorised to use. Keep your sign-in details confidential, protect your device and tell your employer promptly if you suspect unauthorised access. Do not share a session or use another person’s credentials. Provide accurate information when you submit a request, and correct errors you become aware of.
For an account, permission or employment-record issue, your employer is usually the first point of contact. For an app problem, contact us with enough information to investigate, without sending passwords or unnecessary sensitive records.
3. Workplace information and requests
Kimo displays information supplied by your organisation and supports the features it enables, such as viewing shifts, making leave requests and receiving work notifications. Availability may vary with your role, company configuration, connection and app version. Some functions retain information locally; do not assume an entry has reached your employer unless its submission or synchronisation has been confirmed.
A leave request is not approved simply because it has been submitted. The displayed status and your employer’s authorised decision determine its outcome. Similarly, a shift request, swap, cover request or other submission may require confirmation under your employer’s process.
Cached information may be out of date and notifications may be delayed or disabled. If something important is missing or appears incorrect, check with your manager or HR team. Kimo is not an emergency communication service.
Your employment contract, applicable workplace policies and the law determine matters such as pay, working time, leave entitlement and approval authority. Kimo does not replace them or transfer your employer’s legal responsibilities to you. An estimate or display in the app is not independent legal, tax or payroll advice.
4. Acceptable use
Use Kimo for lawful, authorised workplace purposes. In particular, do not:
- Access records, accounts or company environments without permission, or attempt to bypass access controls.
- Impersonate someone, falsify workplace records or submit material you are not entitled to provide.
- Introduce malicious code, disrupt the service or use automation that compromises its security or availability.
- Harvest or disclose another person’s information without an appropriate authority or legal basis.
- Use the service to harass others or infringe their privacy, intellectual property or other legal rights.
These restrictions do not prevent activities that cannot lawfully be restricted, rights under applicable open-source licences, protected disclosures or legitimate reports to a regulator. Report a suspected vulnerability privately to info@periwin.com; do not access other people’s information to demonstrate it.
5. Software, content and ownership
Subject to these terms and the applicable store licence, you may use the app on compatible devices you own or are authorised to use for your authorised workplace purposes. The app, website design, branding and original software belong to Periwin or its licensors. Third-party and open-source components remain subject to their respective licences.
You and your organisation retain the rights you already have in information supplied through Kimo. You authorise us to handle that information only as needed to provide, secure and support the relevant service, in accordance with the applicable organisational agreement, data-protection obligations and Privacy Policy. This is not a transfer of ownership or permission to publish your employment information for advertising.
Do not copy, resell or modify our software or branding beyond the permissions granted by the relevant licence or applicable law. Nothing here limits a statutory right to interoperability, permitted reverse engineering or another right that cannot lawfully be excluded.
6. Privacy and your information
Our Privacy Policy explains the app’s data handling, including employer records, device storage, Firebase Analytics and OneSignal notifications. Your employer’s notice explains its own employment processing. Acceptance of these terms is not blanket consent to personal-data processing or optional device tracking.
You can find contact instructions for account access and deletion requests in the account and data deletion section. Ending app access does not automatically erase employment records that an organisation is entitled or required to keep.
7. Availability, maintenance and updates
We will provide our services with reasonable care and skill. We do not promise uninterrupted access or that every function will be available on every device or company setup. Connectivity, the employer’s HR system, app-store services and notification providers can affect operation.
We may maintain, update or change Kimo to address security, legal requirements, compatibility or service improvements. Install supported updates and keep your operating system reasonably current. Where a planned change materially affects access or a core function, we will give reasonable notice where practicable, taking account of urgent security or legal needs and the relevant organisational agreement.
Links to third-party services do not make their content ours. Those providers’ own terms may apply. Their involvement does not remove responsibilities that the law places on Periwin.
8. Suspending or ending access
Your employer may change or end your access when your role, employment or authorisation changes. We may restrict access where reasonably necessary to address a security threat, unlawful activity, a material breach of these terms or the end of the relevant organisational service.
Any restriction should be proportionate to the reason for it. Where lawful and practicable, we will explain the reason and provide an opportunity to resolve a remediable issue. Immediate action may be necessary to protect people, information or the service. Contact your employer or us if you believe access was restricted in error.
You may stop using and uninstall the app. Tell your employer if you need another way to receive work information. Uninstalling does not cancel your employer’s agreement or submit a data-deletion request. Data handling after access ends remains subject to applicable law, the organisational agreement and the Privacy Policy.
9. Responsibility and legal rights
We are responsible for loss or damage caused by our breach of these terms or failure to exercise legally required care where that loss was reasonably foreseeable. We are not responsible for loss to the extent it was caused by matters outside our reasonable control and not by our own breach, fault or failure to take legally required precautions.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any responsibility that cannot lawfully be excluded or limited. Nothing removes your mandatory consumer rights, employment rights, data-protection rights or statutory remedies.
If you have rights as a consumer under applicable law, those rights apply in addition to these terms. Liability and remedies between Periwin and a customer organisation under a separate service agreement are governed by that agreement, subject to applicable law; its commercial limits are not imposed on you merely because you use an employer-provided account.
Please tell us about a problem promptly so that we can investigate and try to resolve it. This request does not shorten any statutory time limit for bringing a claim.
10. Apple App Store and Google Play
When you obtain Kimo through a store, its applicable account, distribution and usage rules also apply. For an iOS download, Apple’s Standard Licensed Application End User Licence Agreement applies to the software licence where no valid custom licence has been supplied through the App Store. These service terms do not purport to replace that licence or override mandatory store terms. For Android, applicable Google Play Terms of Service also apply.
Periwin is your contact for Kimo support. The store operator is not your employer and does not decide leave requests, maintain your organisation’s HR records or administer your workplace account. Store complaint or refund processes, where relevant, remain available under their own terms and applicable law.
11. Changes to these terms
We may revise these terms for changes to the service, applicable law, security or organisational arrangements. The date above identifies the current version. We will give reasonable notice of material changes through an appropriate service or organisational channel where practicable, and obtain agreement where legally required.
Changes will not retrospectively remove accrued rights. If you have concerns about a change, contact us and your employer before it takes effect to discuss continued access or an alternative arrangement. Changes to these terms do not substitute for any separate privacy notice or consent required by law.
12. Applicable law, concerns and contact
These terms are governed by the law of England and Wales. Courts in England and Wales may hear disputes, but this does not prevent you from relying on mandatory protections or bringing proceedings in another court where applicable law gives you that right, including protections available to consumers in their place of residence.
If part of these terms is unenforceable, the remaining terms continue to apply to the extent lawful. A delay in exercising a right does not, by itself, waive it. These terms do not require private arbitration or restrict a complaint to a regulator.
